Terms of Service (TOS)

The purpose of these terms of service (the “TOS”) is to set the legal framework governing how the site and the services of the Bolid mobile application are made available, and to define the conditions under which the services may be accessed and used by “the User”.

These TOS are available on the site under the “TOS” heading.

Any registration on or use of the site implies the User’s acceptance of these TOS without reservation or restriction. When registering on the site through the registration form, each user expressly accepts these TOS by ticking the box preceding the following text: “I acknowledge that I have read and understood the TOS and I accept them”.

Should the User not accept the TOS set out in this agreement, the User must refrain from accessing the services offered by the site.

Bolid reserves the right to modify the content of these TOS unilaterally and at any time.

Article 1: Legal notice

The Bolid application is hosted by Scaleway, whose registered office is at 8 rue de la Ville l’Evêque, 75008 Paris, France.

ARTICLE 2: Access to the site

The Bolid application gives the User free access to the following services:

The site is freely accessible from any location to any User with Internet access. All costs incurred by the User in order to access the service (computer equipment, software, Internet connection, and so on) are borne by the User.

A User who is not a member does not have access to the restricted services. To obtain access, the User must register by completing the form. By agreeing to register for the restricted services, the member User undertakes to provide truthful and accurate information concerning their civil status and contact details, in particular their email address.

To access the services, the User must then sign in using the username and password provided to them after registration.

Any duly registered member User may also request to be unsubscribed by going to the dedicated page in their personal area. This will take effect within a reasonable period of time.

Bolid accepts no liability for any event of force majeure resulting in a malfunction of the site or server, nor for any interruption or modification arising from maintenance. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without notice.

The User may contact the site by electronic mail at the publisher’s email address given in ARTICLE 1.

ARTICLE 3: Data collection

The site guarantees the User that personal information is collected and processed with respect for privacy, in accordance with French Act No. 78-17 of 6 January 1978 on information technology, data files and civil liberties. The site is registered with the CNIL under a number that is currently pending.

Under the French Data Protection Act of 6 January 1978, the User has the right to access, rectify, erase and object to the processing of their personal data. The User exercises this right:

ARTICLE 4: Intellectual property

The trademarks, logos and signs, as well as all the content of the site (text, images, sound and so on), are protected by the French Intellectual Property Code and more particularly by copyright.

The User must obtain the site’s prior authorisation for any reproduction, publication or copying of the various contents. The User undertakes to use the content of the site strictly for private purposes; any use for commercial or advertising purposes is strictly prohibited.

Any total or partial reproduction of this site by any means whatsoever, without the express authorisation of the website operator, would constitute an infringement punishable under Article L 335-2 and following of the French Intellectual Property Code.

It is recalled, in accordance with Article L122-5 of the French Intellectual Property Code, that a User who reproduces, copies or publishes protected content must cite the author and the source.

ARTICLE 5: Liability

The sources of the information published on the Bolid application are deemed reliable, but the site does not guarantee that it is free of defects, errors or omissions.

The information provided is given for general guidance only and has no contractual value. Despite regular updates, the Bolid application cannot be held liable for changes to administrative and legal provisions occurring after publication. Likewise, the site cannot be held liable for the use and interpretation of the information contained in this site.

The User must keep their password secret. Any disclosure of the password, in any form, is prohibited. The User assumes the risks associated with the use of their username and password. The site accepts no liability in this respect.

The Bolid application cannot be held liable for any viruses that might infect the computer or any other equipment of the Internet user following use of, access to, or a download from this site.

The site cannot be held liable in the event of force majeure or of an unforeseeable and insurmountable act of a third party.

ARTICLE 6: Hypertext links

Hypertext links may be present on the site. The User is informed that clicking on these links will take them out of the Bolid site. Bolid has no control over the web pages these links lead to and cannot under any circumstances be held responsible for their content.

ARTICLE 7: Cookies

The User is informed that, during visits to the site, a cookie may be installed automatically in their browser software.

Cookies are small files stored temporarily on the hard disk of the User’s computer by the browser, and which are necessary for the use of the Bolid site. Cookies contain no personal information and cannot be used to identify anyone. A cookie contains a unique identifier that is randomly generated and therefore anonymous. Some cookies expire at the end of the User’s visit; others remain.

The information contained in cookies is used to improve the Bolid application.

By browsing the application, the User accepts them.

The User may disable these cookies through the settings in their browser software.

ARTICLE 8: Applicable law and competent jurisdiction

French law applies to this agreement. Should a dispute between the parties not be settled amicably, the French courts alone shall have jurisdiction to hear it.
